The Palace of Justice

The Latin term, from which the Italian "tribunale" derives, originally indicated the tribune from which the judge administered justice. In the Italian judicial system, the court identifies the judicial body that has a single or collegial composition (single judge of first instance). In the civil field it has jurisdiction for all cases that are not within the jurisdiction of the justice of the peace. It is also always competent for all causes relating to the state and capacity of persons, for the complaint of forgery, for the declaration of bankruptcy and the causes deriving from it, as well as for disputes of indeterminable value. He is also an appeal judge with respect to the judgments of the justice of the peace. In criminal matters, the ordinary court, which exercises jurisdiction at first instance,

The main function of the Tribunal is to ensure a  just  and  timely response the needs of citizens to see their disputes resolved - whether large or small - so much so that "the reasonable duration of the process" has always been an objective to be pursued, as well as a fundamental value of our Constitution. The same art. 6 of the European Convention on Human Rights of 1950, which entered into force in our system only in 1955, establishes "The right of every person to a fair and public hearing within a reasonable time, before an independent and impartial tribunal established by law , for the purpose of determining both his civil rights and duties, and the validity of any criminal accusation that is addressed to him ".

This statuition, synthetically expressive of fundamental juridical principles elaborated by the European juridical systems, which today has found further recognition in art. 111 of the Constitution, in which, among other things, it was decided to reiterate that "The law ensures the reasonable duration" of the process in conditions of equality between the parties and impartiality and impartiality of the judge.
